What are the 7 essential elements of a contract?

Answered by the UK Wedding Websites editorial team · Updated 2026-10-12

Short answer

A valid contract needs offer, acceptance, consideration, intention to create legal relations, capacity, certainty, and legality. Without all seven, a wedding contract may not be enforceable.

For a wedding contract, these seven elements matter in practical ways. Offer: the venue or supplier states what they will provide, such as a room, catering or photography. Acceptance: you agree to those terms, usually by signing or paying a deposit. Consideration: something of value changes hands, normally money, but it could be a service. Intention to create legal relations: both sides expect the agreement to be legally binding, which is standard in commercial contracts. Capacity: both parties are over 18 and mentally able to enter a contract. Certainty: the terms are clear enough that a court could understand them, so avoid vague phrases like "reasonable decorations". Legality: the contract cannot involve anything unlawful, such as serving alcohol without a licence. In practice, you will not need to check every element yourself, but knowing them helps you spot problems. If a supplier's contract is missing key details, such as the date, time, location or what happens if they cancel, ask for those to be added in writing. If you are unsure whether a contract is valid, ask a solicitor or check with Citizens Advice. Do not rely on verbal promises. Always get the final terms in writing before you pay a deposit.
