Short answer
Both partners must give notice of marriage. In England and Wales, each person gives notice at their local register office. In Scotland and Northern Ireland, each partner submits a notice to the registrar for the district where the wedding will take place.
Both partners must give notice, not just one. This applies whether you are a same-sex or opposite-sex couple, and whether you are marrying in a civil or religious ceremony. The only exception is a Church of England or Church in Wales wedding, where banns or a licence replace giving notice at a register office.
In England and Wales, each partner gives notice at the register office for the district where they have lived for at least the last 7 days. If you live together, you can often go to the same register office together. If you live in different areas, you may each need to visit your own local office. You do not have to give notice on the same day, but both notices must be given before the 28 day countdown can begin.
In Scotland, each partner submits a marriage notice to the registrar for the district where the wedding will take place. You do not both need to attend in person, but both notices must be submitted at least 29 days before the wedding.
In Northern Ireland, both partners give notice to the registrar in the district where the wedding will take place, at least 28 days before.
If either partner has been married before, you will need to show evidence that the previous marriage ended, such as a decree absolute or death certificate. If you are under 18, you cannot marry in the UK, as the minimum age is 18 since February 2023. If you are subject to immigration control, the notice period may be longer. Always check with the register office for your specific situation.
