What makes a nikah invalid in Islam?

Answered by the UK Wedding Websites editorial team · Updated 2026-10-12

Short answer

A nikah can be invalid if the required conditions are not met, such as lacking a valid offer and acceptance, a guardian's consent where needed, or two witnesses.

The validity of a nikah depends on several core conditions agreed upon by scholars. If any of these are missing, the marriage may not be recognised as valid.

Key requirements usually include a clear offer from one side and acceptance from the other, spoken in the same sitting. Both parties must be willing, of sound mind, and old enough to marry. In many traditions, the bride's guardian, or wali, gives consent, though some schools allow a woman to marry without one if she chooses.

Two adult Muslim witnesses, usually male, must be present and hear the contract. The mahr, a gift from the groom to the bride, must be agreed and is her right. Prohibited degrees of relationship, such as marrying a close relative, also invalidate the union.

Because interpretations differ between schools and communities, rules can vary. If you are unsure about a specific situation, ask an imam or scholar at your local mosque or check GOV.UK for the legal side of marriage in England and Wales.
